Terms of Service

1. Who we are

ShapesShifter (the "Service"), available at shapesshifter.com, is operated by APEX VISION SRL, a company registered in Romania, Trade Register no. J202518587002, tax identification code (CUI) 51454508, with its registered office at Str. Mihai Eminescu nr. 77, Zalău, Romania ("we", "us"). You can reach us at contact@shapesshifter.com.

By creating an account or buying a subscription you accept these Terms. If you do not agree, please do not use the Service.

2. What the Service does

ShapesShifter lets you load a photo of an avatar, choose one feature (nose, lips, eyes, eyebrows, bust, hips or silhouette), align a reference shape from our library over it, and export (a) the photo with the reference shape drawn on it and (b) a text prompt describing the change. It also offers prompts to help you create an avatar.

The Service does not generate, edit or store the final image. You take the exported image and prompt to a third-party image generator of your choice (for example Google Flow or Nano Banana Pro). Those generators are operated by other companies under their own terms. We are not affiliated with them and are not responsible for their availability, pricing, content policies or output.

Because the final image is produced by a third-party generator, we cannot guarantee any particular result. Outcomes vary between attempts and some shapes may need several tries.

3. Eligibility and account

• You must be at least 18 years old to use the Service.
• You need an account with a valid email address. Keep your login details confidential; you are responsible for activity under your account.
• Your subscription is personal. Do not share your account or resell access to the Service.

4. Acceptable use

You may use the Service only with images you have the right to use. In particular, you must not:

• use a photo of a real person other than yourself unless that person is an adult who has given you clear consent;
• use any image depicting, or appearing to depict, a minor;
• create sexual or intimate imagery of a real person, or any content that is unlawful, harassing, defamatory or hateful;
• create content intended to impersonate someone or to mislead people into believing an image is authentic when it is not;
• break the rules of the image generator you use with our exports;
• copy, scrape, extract or redistribute the shape library, prompts or software, or try to bypass access controls.

Where you publish AI-generated or AI-edited images, you are responsible for complying with applicable disclosure rules, including labelling them as AI-generated where the law requires it.

We may suspend or close an account that breaches these rules. Where the breach is serious, we may do so without notice and without refund.

5. Subscriptions, prices and payment

• The Service is offered as a monthly subscription (€9) or an annual subscription (€79). Prices include all applicable taxes (VAT, GST or sales tax). The total you pay is the one shown at checkout, which may be displayed in your local currency.
• Who you pay. Subscriptions are sold through Link, a service provided by Stripe, which acts as the merchant of record (authorised reseller) for your purchase. Link appears as the seller on your receipts and invoices, collects and pays the applicable taxes, and sends you those documents by email. Your card statement shows "LINK.COM*" followed by our name. Link's own terms apply to the payment; these Terms apply to your use of ShapesShifter. We never see or store your full card details.
• Payment is taken at the start of each billing period.
• Your subscription renews automatically at the end of each period for the same length, at the then-current price, until you cancel.
• If we change the price, we will tell you by email at least 30 days before it applies to your next renewal. You can cancel before then if you do not accept the new price.
• If a payment fails, we may retry it and may pause access until it succeeds.

6. Cancellation, refunds and your right of withdrawal

You can cancel anytime from your account, or from your Link account at link.com. Cancellation stops the next renewal; you keep access until the end of the period you have already paid for.

15-day money-back guarantee. If you are not satisfied, email us within 15 days of your first payment for a subscription and we will refund that payment in full. This guarantee covers and extends the 14-day right of withdrawal that consumers in the European Union have by law. Full details are in our Refund & cancellation policy.

7. Intellectual property

The Service, including the software, the shape library, the shape descriptions and the prompt texts, belongs to us or our licensors and is protected by law. Your subscription gives you a personal, non-exclusive, non-transferable right to use the Service while your subscription is active.

The images and prompts you export are yours to use, including commercially, subject to these Terms and to the terms of the generator you use. You keep all rights in the photos you load.

8. Your photos

Photos you load are processed inside your own browser. They are not uploaded to our servers through the Service, and we do not have access to them. See our Privacy policy.

9. Availability and changes

We work to keep the Service available but cannot promise it will be uninterrupted. We may improve or change features, the library or these Terms. If a change to these Terms materially affects you, we will notify you by email or in the Service before it takes effect.

10. Liability

Nothing in these Terms limits liability that cannot be limited by law, including your statutory rights as a consumer. Subject to that, we are not liable for indirect or consequential losses, for the output of third-party generators, or for how you use exported images. Our total liability to you for any claim related to the Service is limited to the amount you paid for the Service in the 12 months before the claim.

11. Law and complaints

These Terms are governed by Romanian law. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live. Please contact us first at contact@shapesshifter.com — we aim to answer within 5 working days.

Consumers in Romania may also contact the National Authority for Consumer Protection (ANPC) and use alternative dispute resolution through reclamatiisal.anpc.ro. Disputes may be brought before the competent courts in Romania, without affecting your right as a consumer to go to the courts of your country of residence.
